2008 Adrenaline Freaks Track Dates

TRACK DAY RIDERS DECLARATION/DISCLAIMER AND RELEASE FOR ADRENALINE FREAKS, (hereafter referred to as AF)

I, the undersigned, wish to ride motorcycles and/or participate in the above event organized by Adrenaline Freaks. **You must initial where ever you see a "___" as well as sign at the bottom**

___ I understand that this motor sport is hazardous and that I am voluntarily exposing myself to risk of damage or loss or personal injury by participating in this track event. This means that there is a possibility that I may break, sprain, tare, dislocate, strain, every bone, muscle, ligament, and tendon in my body. There is also the possibility of paralysis and even death! Despite this, I understand that RACING IS PROHIBITED and that the purpose of the day is to allow the participants to improve their skills and learn the handling and braking characteristics of the motorcycles they are using.

___ I understand that any insurance carried by the promoter and/or the event location operator in respect of liability which might arise out of the track day will be limited and that my own vehicle, medical, third party, and public liability insurance (if any) is unlikely to cover me for losses, liabilities or personal injury.

I also understand the following:

Up to 10 days prior - 90%
Up to 8 days prior - 75%
7 days or later - NO REFUNDS!

Meaning that if you wait to cancel, you will lose all of your money, NO EXCEPTIONS!!! If you have paid using Pay-Pal, and cancel at any time, a $5.00 fee will be charged. NO EXCEPTIONS!!! Also, please note that the promoter has the right to cancel the event in the case that there is not enough interest or the minimum amount of pre-paid riders. The promoter will make every effort to keep the attendees up to date as to the progress of the minimum cutoff of riders. The event will go on Rain or Shine. If it is deemed too dangerous due to track conditions, the promoter has the right to cancel the event. In the event that the trackday is cancelled due to Inclement weather, no refunds will be issued. No matter how powerful you may think Adrenaline Freaks may be, we can't control the weather.

I declare:

___ I am fit and healthy and that my eyesight (with lenses if to be worn) is adequate for track use, and that I am not suffering from any other medical condition or disability which is likely to adversely affect my normal control of a vehicle or which might make it unsafe for me to drive or participate in any other motorsport activity. Also, that any motorcycle for which I am responsible and/or which I will use on the track is in good and suitable mechanical condition.

___ I hold a current drivers license with a motorcycle endorsement, entitling me to use on the public roads in WA or any other state that AF may have an event in, a motorcycle the size and type that I will be using on the track. I also understand that if I am a racer, I may or may not have an endorsement but my current race license can and will be used in its place to as a means of showing riding experience.

___ I will not participate in the track day while under the influence of alcohol or intoxicating drugs.

___ I have spoken to my immediate family and have explained to them these inherent risks and have informed them that this is my choice and that I do so freely. Furthermore, I have informed them that by attending the event and signing this form, I and my immediate family agree to make no claim against AF or its officers or agents in respect of any loss or injury suffered by me during the track day and to indemnify them against their costs and losses arising out of any claim made against them by anyone to the extent that such costs and losses are attributable directly or indirectly to my participation in the track day.

___ I agree that AF may use my pictures and my name (including pictures taken at any event or pictures of my racing equipment as well as my street bike if I am a street rider) for any purpose in any media.

___ I agree to abide by AF's Track Day rules and regulations at the events to which they apply and to respect the authority of the event officials at all AF and AF Sanctioned events.

___ I have read and agree with the above declaration and indemnify/release and agree that its terms will also apply to my participation in any future track day organized by the promoter unless I sign a subsequent declaration and indemnity/release, which will then take precedence.

___ I understand that AF reserves the right to remove me from any of its venues if they consider my actions to be dangerous or detrimental to other venue users. By both signing and initialing in the said areas, I understand and take full responsibilities of my actions while in attendance for this and any other AF events in the near future and hereby release AF of any and all liability present or future.

___ I understand that other participants are of varying skill levels and may be less or more competent than my self, therefore the probability of entanglement, ie; crashing, getting crashed into, being caused to crash, being run off the track, placed in jeopardy by other participants is an acceptable risk to my self and property and I accept that risk and will not seek damages against AF, its staff, or its attendees (attendees is defined as ANYONE that attends an AF event, wither he/she is a rider/spectator/pit crew/photographer/vendor/etc...)

___ I also understand, that regardless of what type of insurance I may or may not have, that not only covers myself, but my property, I take full responsibility for anything that happens to me or my property regardless of who is at fault. Meaning, that if I get taken out by another rider/attendee, or caused to crash by a rider/attendee/my self/track conditions/safety control/AF Staff, I will not hold anyone but my self responsible.

___ I also understand that if anyone other than myself, operates my equipment without being a registered/paid participant, with or without my approval, I personally accept any liabilities that may arise from such actions, directly or indirectly, and if I/we are found to be guilty of such actions by AF staff or Track staff, we will forfeit any monies paid and may be removed from the premises. This will be a permanent condition, meaning you will be banned from any future AF events.

___ In consideration of the granting to me of a Track Day Pass by AF and in consideration of the promotion and operation for my benefit of track day events by AF and on consideration of the granting of permission to me to enter, use and remain on the track facilities and/or premises of which these events take place by the owners and/or representative thereof, I hereby, for myself, my heirs, personal representatives and assigns, release, discharge and agree to hold harmless and indemnify AF, the owners and/or representatives of the aforesaid track facilities and/or premises as well as the directors, officers, agents, employees and/or members of all of them, of and from all liability, loss claims, demands and possible causes of action that otherwise accrue from loss, damage or injury (including death) to my person or property, in any way resulting from, or arising in connection with, or related to any event, and whether arising while engaged in any on-track activity or while upon entering or departing from said track facilities and/or premises, from any cause whatsoever, including, without limitation, the failure of anyone to enforce rules and regulations, failure to make inspections, or the negligence of other persons.

___ I UNDERSTAND THIS MEANS NEITHER I NOR ANYONE ON MY BEHALF AND THIS INCLUDES ANY FAMILY MEMBER, CAN SUE ANYONE IF I AM INJURED OR KILLED, OR MY PROPERTY IS DAMAGED IN ANY WAY AND EVEN IF MY INJURY OR DEATH IS CAUSED BY SOMEONE'S NEGLIGENCE... I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS' CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND THE RELEASEES. (The releasees are defined as the promoter, participants, racing associations, sanctioning organizations, track operator, track owner, officials, motorcycle owners, riders, drivers, pit crews, sponsors, advertisers, owners and lessees of the premises used to conduct the event, any officers or employees of the above, or any persons in any restricted area). (A restricted area is defined as including, but not limited to, the racing surface, pit areas, infield, burnout area, approach area, shutdown area, and all grandstands, buildings, viewing areas, walkways, concessions or other areas appurtenant to any area where any activity related to the events shall take place).

___ I VOLUNTARILY SIGN AND FURTHER AGREE THAT NO ORAL REPRESENTATIONS, STATEMENTS OR INDUCEMENTS APART FROM THE FOREGOING WRITEN AGREEMENT HAVE BEEN MADE.
